Circumstances of claim

Our client had brought her car to a stop to accommodate a car up ahead which was making a right-hand turn. The van travelling behind her had also stopped, however a car approaching the queue of traffic failed to stop and collided with the van causing this to then collide with our client’s stationary vehicle.

Our client sustained soft tissue injuries to her neck and back. Her physical injuries were initially expected to resolve within six months of the accident date. Our client also suffered psychological symptoms after the accident, including flashbacks, changes in mood and insomnia. 

We intimated her claim on the third-party insurers, who admitted liability for the accident and agreed to deal with her claim. They initially offered our client compensation in the sum of £3,200.  We advised our client to await the outcome of her physiotherapy treatment and a psychological assessment.

Following her treatment, we arranged for our client’s medical evidence to be updated to reflect that she did not recover in full of her physical injuries until 12 months post-accident. We also arranged for our client to be assessed by a Consultant Psychiatrist who confirmed that she was suffering from symptoms of Post-Traumatic Stress Disorder as a result of the accident.

Our client’s claim settled for just over £9,200.
