Circumstances of accident

We acted on behalf of a client whose child suffered severe burns to her face as a result of hitting a hot iron in a fabric store in Dundee.

The client and his daughter were in the shop to pick up supplies when the accident occurred. The shop alleged that they were training up a new member of staff which is why the hot iron was left on the counter. The client’s father went back to the shop the next day to take further information and noticed the hot iron was in the exact same location.

The insurers for the shop did not respond to the claim which resulted in a court action being raised against the shop.

How we helped our client 

As a result of the severe burns suffered by our client, we had the child examined by a consultant plastic surgeon for the purposes of a medical report. The expert identified the short- and longer-term prognosis for the injury together with the appropriate treatment required to aid with her recovery.

Shortly after raising the Court Action, the Defenders offered to settle for a four-figure sum.

This outcome enabled the young child and her family to get the treatment she required to ensure she made a full recovery from her injuries. The defenders were reluctant to engage in this claim and it was only after raising an action that we could secure such a favourable settlement.
