Our client had taken a day trip to Fife and was driving through a small rural village. He approached a cross junction where he noticed a bus giving way to his left. As he drew level with the bus, it pulled out in front of him and struck the passenger side of his vehicle. There was nothing he could have done to avoid the collision.

The insurance company for the bus denied liability. We raised a court action in order to ensure our client was compensated for his losses and injuries.

The bus driver had told his insurers he pulled out as our client had his indicator on. He thought it was safe to pull out when the collision occurred. This was contrary to our client’s version of events as it was his intention to proceed straight on.

We were able to take a statement from a witness who observed the accident. They stated our client in fact did not have his indicator on. Therefore, after initially denying liability, the bus driver’s insurers made an offer to settle for a four-figure sum. Through the investigations and work carried out by us, we were able to ensure the driver received a fair settlement for his injuries and losses. This was despite the initial denial of liability from the third-party insurer and the bus driver holding our client at fault for the accident.
