Circumstances of accident
We acted on behalf of our client, who was holidaying in Costa Adeje staying in accommodation booked through Jet2Holidays as part of a package holiday deal.
At the time of the incident, our client was asleep in his room. Our client woke from his sleep and stepped onto the floor to make his way to the bathroom, when suddenly he slipped on wet floor tiles due to water deriving from the ceiling vent causing him to fall and hit his head on the table resulting in injury and subsequent losses.
How we helped our client
Our client’s contract with Jet2 Holidays was one which was governed by the Package Travel, Package Holidays and Package Tours (1992 Regulations) .
We considered that Jet2 Holidays as the travel provider was liable to our client for the injuries caused due to poor maintenance by their service providers within the accommodating hotel.
A leaking air vent represents a major slip hazard, and the hotel staff should have replaced or repaired the air conditioner before providing the room to guests. Therefore, it was reasonably foreseeable that such an incident should occur.
Settlement
We secured a good settlement for the claimant which consisted of compensation in respect of injuries occurred and loss of enjoyment of the remainder of his holiday.
