Our client, a child, was a passenger in the vehicle when a third-party vehicle (a van) collided with the rear end of the client’s vehicle on a slip road on the approach to a motorway.

Our client sustained soft tissue and psychological injuries as a result. 

How we helped our client

We intimated our client’s claim to the third-party insurers.  They responded to us to confirm that they accepted liability for our client’s accident.

We recovered a copy of our client’s medical records and instructed a report from an independent General Practitioner, who confirmed our client’s physical and psychological symptoms.  As our client’s psychological symptoms did not resolve within the initial prognosis period for recovery, we arranged for our client to be seen by a Psychiatric Consultant who confirmed our client as having sustained PTSD following the incident.

The medical reports confirmed our client’s physical injuries would resolve four weeks following the incident.  The Psychiatric Consultant recommended our client undergo Trauma Focussed Cognitive Behaviour therapy or EMDR therapy confirming our client’s psychological symptoms should resolve 6 to 12 months following initiation of treatment.

Settlement

The Third Party Insurers have made a previous offer to settle our client’s claim in the sum of £650. However as a result of obtaining further medical evidence confirming further treatment was required, and prior to the matter proceeding to a Court hearing, the Defender’s Solicitors made an offer of settlement in the form of a Minute of Tender in the sum of £8,000 which was accepted by our client.
