Circumstances of claim

Our client was driving his car and approached a junction. He indicated his intention to turn right into the junction. However, a motorbike travelling immediately behind his car then attempted to overtake his vehicle as he made his right-hand turn.

Our client’s vehicle was written off following the accident.

Our client sustained soft tissue injuries to his neck and back. We arranged for him to be examined by an independent GP who advised that he should recover from his physical injuries within 7 months of the accident date. Our client was a bricklayer who was unable to work for two weeks after the accident, and so he had an additional claim for his loss of earnings.

We intimated our client’s claim upon the third-party insurers who failed to respond to the claim. We therefore required to raise a court action on our client’s behalf in order to pursue his claim for his injuries and for his loss of earnings.

The third-party insurers instructed solicitors to act for them in the court action and lodged a tender to settle our client’s claim.

Our client’s claim settled for £4,000.
