Thousands of holidaymakers from the UK will be jetting off for skiing holidays in Europe during the winter season with Europe offering some of the best ski resorts in the world.

Whilst most holidays will be enjoyed without any issues, skiing is a high-risk adventure sport, and therefore injuries can occur. Sometimes of course these are accidental and could not have been prevented, with no one at fault. However, in some cases, an accident may have been preventable, and, depending on the circumstances, it may be possible to pursue a claim for compensation against another skier, a tour operator or a piste authority. Injuries can also be sustained because of faulty ski equipment and so, it may be possible to make a claim against the manufacturer.

For example, if the incident you were involved in occurred as a result of a collision with another skier, you may be able to establish liability on their part if they breached the Fédération Internationale de Ski code of conduct. This code of conduct has ten basic rules for those using slopes in Europe.

On the other hand, if you are a novice skier or snowboarder, it may be possible to pursue a claim against the ski instructor or tour operator. They have a duty to ensure that you are properly instructed, to supervise you and to make sure you don’t take risks that are beyond your capabilities.

If you are involved in a winter sports accident, it can have devastating and life-changing consequences, and here at Lindsays, our specialist solicitors have extensive experience in assisting people who have been injured in winter sports accidents.

If you have an accident while skiing or snowboarding that was not your fault, it is important to gather the evidence immediately.

We are able to help you seek compensation for injuries, loss of earnings, care and assistance, and damaged equipment.
