Circumstances of claim

At the time of the accident, Aneta was working as a packer in a food processing factory.  As part of her duties, she was required to package hundreds of food products every day.

Unfortunately, her employer had failed to properly risk assess her job and failed to allow her to take the appropriate breaks. As a result, she developed a repetitive strain injury to both wrists. 

How we helped our client

We notified a claim to her employer.  Liability was denied and we therefore raised a court action. We relied on a breach of the Manual Handling Operations Regulations 1992.  We instructed reports from an orthopaedic consultant and psychiatrist and we were then able to negotiate a settlement.

Settlement

Compensation was agreed at £14,000. There were complications with medical causation because Aneta would have suffered wrist problems anyway within two years even if she hadn’t worked as a food processor.
