Our client sustained an injury to his eye in the course of his employment as a car valeter. His employer had instructed our client to remove signs and stickers on a van. In order to do so, he had to use an alkaline chemical spray. His employer did not provide him with any protective eyewear. Whilst spraying the van, some of the chemical blew back into his eye, causing his injuries.

Our client underwent three operations to his injured eye. Eighteen months after the accident, his vision was still poor, and he was unable to drive. He continued to undergo conservative treatment. 

How we helped

We immediately began obtaining information in support of our client's claim. We wrote to his employer to recover health & safety documentation in connection with the task he had been instructed to do at the time of the accident. We obtained his wage loss information, and we also requested his GP and hospital records. We then intimated our client's claim on his employer's solicitors. 

Whilst primary liability was admitted by our client's employer, they initially alleged that that our client was 25% responsible for the accident on the basis that eye protection was available but not used. We investigated this further with our client who confirmed that there was no eye protection available and that he had never received any formal health and safety training for this specific task. Following further discussion with our client's employer's representatives, liability was ultimately conceded in full. 

Thereafter, we obtained an expert medical report from a consultant ophthalmologist to comment upon his injuries and whether ongoing symptoms were directly connected to the accident. The report confirmed that whilst our client's symptoms were stable at this stage, there was a risk of our client's eyesight deteriorating in the future, or even complete blindness.

Outcome

After issuing our valuation of the claim to the employer's representatives, we received an initial offer of £40,000. Due to the complexity of our client's injuries and the life-changing impact of our client's eyesight potentially deteriorating in the future, we reverted with a counter offer and indicated that we would raise a court action if this could not be agreed. Ultimately, the case was successfully settled at £65,000.
