Elena had been suffering with toothache for some time and so she attended her dentist, who advised the tooth would need to be extracted. This procedure took over an hour to carry out and during which the dentist applied excessive force and as a result, Elena suffered from a number of health problems.
How we helped our client
We recovered Elena’s dental records and instructed an expert. His view was that it was negligent of the dentist to continue with the extraction and that he should have referred her to the dental hospital for surgery. A claim was intimated to Elena’s dentist, however liability was denied.
We raised court proceedings on Elena’s behalf and instructed a number of further reports from ENT, psychiatric, and pain management consultants to work out the consequences of the dental treatment. We progressed the court action and shortly after a settlement was agreed.
We advanced a professional negligence claim on Elena’s behalf, on the basis that a resonably prudent dentist of an ordinary level of skill exercising reasonable care would not have continued with the extraction.
Outcome
